Terms of Service

Welcome to Fluencr (“we,” “our,” or “us”). Fluencr is operated by Fluencr Technologies. These Terms of Service (“Terms”) govern your access to and use of our website and platform at fluencr.in (the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

By creating an account, browsing campaigns, posting campaigns, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are using the Platform on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

Fluencr is an influencer marketing platform that connects influencers (creators) with brands. We provide:

• For Influencers: A marketplace to browse and apply to brand campaigns, manage applications, and connect with brands.
• For Brands: Tools to post campaigns, discover creators, review applications, and manage influencer partnerships.

We act as an intermediary and do not guarantee any particular outcome, campaign acceptance, or business relationship between users.

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activities under your account.

You must be at least 18 years old to use the Platform. By using the Platform, you represent that you meet this age requirement.

If you use the Platform as an influencer or creator:

• You represent that the profile information you provide (including follower counts, engagement metrics, and portfolio links) is accurate and not misleading.
• When you apply to a campaign, you consent to sharing your contact information with the brand for the purpose of that campaign.
• Any agreement between you and a brand (including deliverables, payment, and timelines) is solely between you and the brand. Fluencr is not a party to such agreements.
• You are responsible for fulfilling your obligations under any campaign you accept.

If you use the Platform as a brand:

• You represent that you have the authority to post campaigns and enter into agreements with influencers on behalf of your organization.
• When an influencer applies to your campaign, you will receive their contact information to facilitate direct communication.
• Any agreement between you and an influencer (including deliverables, payment, and timelines) is solely between you and the influencer. Fluencr is not a party to such agreements.
• You are responsible for paying influencers according to the terms you agree upon.

Subscription fees for brands are charged in accordance with our pricing plans. Payment processing is handled by Razorpay. By subscribing, you agree to our payment terms and any applicable refund policy.

Fluencr does not process payments between influencers and brands. All payments for campaign work are made directly between the parties. We are not responsible for any payment disputes.

The Platform, including its design, features, content, and underlying technology, is owned by Fluencr Technologies and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of content you upload (e.g., profile photos, campaign briefs). By uploading content, you grant Fluencr a non-exclusive, royalty-free license to use, display, and distribute that content for the purpose of operating the Platform.

You agree not to upload, post, or transmit content that:

• Is false, misleading, or deceptive.
• Infringes any third party's intellectual property or privacy rights.
• Is defamatory, obscene, or otherwise objectionable.
• Contains malware, viruses, or harmful code.
• Violates any applicable law or regulation.

We reserve the right to remove content that violates these Terms or that we deem inappropriate, without prior notice.

You may not:

• Use the Platform for any illegal purpose.
• Impersonate another person or entity.
• Circumvent or attempt to circumvent Platform features or security measures.
• Scrape, harvest, or collect data from the Platform without our consent.
• Use the Platform to spam, harass, or harm others.
• Create multiple accounts to abuse the Platform.

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may close your account at any time through your account settings.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not endorse, guarantee, or assume responsibility for any content, products, or services offered by users. Your interactions with other users are solely between you and them.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENCR TECHNOLOGIES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED INDIAN RUPEES (₹100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Fluencr Technologies, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third party's rights.

Any disputes arising from these Terms or the Platform shall be governed by the laws of India. You agree to first attempt to resolve any dispute informally by contacting us. If the dispute cannot be resolved within 30 days, it may be submitted to binding arbitration or the courts of India, as applicable.

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you via email or a notice on the Platform. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
